4Dlabs Privacy Policy

This Privacy Policy explains how 4Dlabs (“4Dlabs,” “we,” “us,” or “our”) collects, uses, discloses, and protects personal information in connection with 4dlabs.space, our mobile applications, capture devices, contributor programs, software, APIs, data marketplace, model services, and related products and services (collectively, the “Services”).

This Policy applies when 4Dlabs determines why and how personal information is processed. An enterprise customer may separately control personal information that we process on its behalf; in that situation, the customer’s privacy notice applies and requests should generally be directed to that customer.

1. Scope and important notice about contributed data

The Services are designed to capture and process real-world environments and interactions. A photo, video, spatial scan, point cloud, mesh, audio recording, sensor stream, or 3D/4D reconstruction may contain personal information even when a person is not the intended subject. It may reveal a face, voice, body movement, hand geometry, precise location, home layout, possessions, workplace, device, behavior, or relationship.

Before capturing or uploading data, contributors must review the scene, provide legally required notice, obtain all required permissions, and avoid private or sensitive information. Do not capture children, private spaces belonging to others, health or financial information, confidential business processes, security credentials, or people who have not agreed to be recorded.

We may use qualifying contributed data to build, improve, evaluate, and commercialize datasets, simulations, AI or robotics models, and related services, and may license it to customers. Section 4 describes these purposes and Section 5 describes the recipients. Where contributed data contains personal information, we process and license it only as permitted by applicable law, this Policy, contributor notices and consents, and our customer contracts.

2. Personal information we collect

The categories below describe information we may collect. The features you use determine what actually applies.

A. Information you provide

  • Account and profile: name, username, email address, phone number, country or region, age or eligibility confirmation, organization, profile image, language, and account credentials.
  • Contributor and verification: task history, consent or release records, rights information, contributor ID, identity or eligibility verification results, tax information, sanctions-screening results, payment account details, and wallet address. Verification and payment providers may collect identity documents directly and return confirmation or risk signals to us.
  • Contributor Content: video, images, audio, depth data, point clouds, meshes, 3D/4D reconstructions, spatial maps, sensor data, motion and pose, tactile and force measurements, inertial data, teleoperation data, task demonstrations, labels, annotations, scene descriptions, timestamps, device information, location, and other metadata you submit.
  • Communications: support requests, survey responses, contest entries, feedback, and messages you send us.
  • Transaction information: purchases, subscriptions, invoices, rewards, points, redemption history, payment status, and blockchain transaction identifiers. Payment card details are generally processed by our payment provider rather than stored by us.

B. Information collected automatically

  • Device and network: IP address, browser and device type, operating system, app version, language, identifiers, mobile carrier, and approximate location derived from IP.
  • Usage and diagnostics: pages or features viewed, links clicked, session times, referring pages, logs, crash reports, performance data, and interactions with emails or campaigns.
  • Capture-device telemetry: device identifier, firmware, sensor status, calibration, battery, connectivity, error logs, and operational measurements.
  • Cookies and similar technologies: necessary storage, preferences, security signals, analytics identifiers, and, if used with required consent, advertising identifiers. See Section 9.
  • Public blockchain information: wallet addresses, transaction hashes, token or NFT activity, smart-contract interactions, and other data visible on a public ledger.

C. Information from other sources

We may receive information from enterprise customers, campaign partners, referral partners, social or authentication providers, app stores, device distributors, data licensors, public sources, fraud-prevention services, analytics providers, and other users who submit content containing you.

D. Sensitive information and biometric-capable data

Contributor Content may incidentally contain precise geolocation, face or voice recordings, body or hand geometry, motion patterns, home interiors, or other information considered sensitive in some jurisdictions. Sensor data is not necessarily biometric data, but it may become biometric information if processed to identify or authenticate a person.

Unless a feature gives you a separate, specific notice and obtains any consent required by law, 4Dlabs does not use face, voice, body, hand, tactile, or motion data to establish a person’s identity or for biometric authentication. We prohibit contributors and customers from using the Services to identify or re-identify people except under a separate written agreement and where legally permitted.

We do not intentionally collect health, genetic, government-ID, financial-account credential, racial or ethnic origin, religious-belief, sexual-life, or similar highly sensitive information through general capture tasks. Do not upload it unless a specific program expressly requests it, explains the purpose, and provides the required safeguards and consent process.

3. Sources and collection context

We collect personal information:

  • directly from you when you register, participate, capture, upload, communicate, purchase, or request support;
  • automatically from websites, apps, capture devices, APIs, and network activity;
  • from contributors whose captures may include another person;
  • from organizations that sponsor or manage capture programs;
  • from service providers and partners; and
  • from public blockchains and other lawfully available sources.

If you provide personal information about another person, you must have authority to do so and must provide any notice and obtain any consent required by law.

4. How we use personal information

We may use personal information to:

  1. Provide the Services: create accounts; authenticate users; operate websites, apps, devices, captures, uploads, reconstructions, datasets, APIs, and model services; process transactions; and provide support.
  2. Operate contributor programs: publish tasks; assess provenance, quality, scarcity, and eligibility; detect duplicate or manipulated submissions; calculate points or rewards; keep rights records; administer leaderboards; pay rewards; and handle tax or compliance obligations.
  3. Process contributed data: store, clean, calibrate, synchronize, label, annotate, combine, reconstruct, augment, de-identify, quality-score, verify, and organize Contributor Content.
  4. Research, develop, and commercialize: conduct research and analytics; develop, train, fine-tune, test, benchmark, evaluate, and validate AI, robotics, simulation, spatial-computing, and world-model systems; create derived or synthetic data; build datasets, model weights, embeddings, features, statistics, and tools; and license or provide these outputs and qualifying contributed data to customers.
  5. Improve and personalize: understand usage, troubleshoot, improve safety and performance, remember settings, and develop new features.
  6. Protect the platform: verify identity and rights; prevent fraud, abuse, security incidents, unsafe capture, and prohibited use; enforce agreements; and protect people, property, and the Services.
  7. Communicate: send service messages, policy updates, security notices, support responses, and, with required consent, marketing or campaign communications.
  8. Comply with law and corporate obligations: respond to lawful requests; satisfy sanctions, export, accounting, tax, audit, and recordkeeping duties; establish or defend legal claims; and support a merger, financing, acquisition, reorganization, or asset sale.

We may aggregate or de-identify information so it can no longer reasonably be linked to a person. We may use and disclose such information for any lawful purpose and will not attempt to re-identify it except to test whether de-identification is effective or as permitted by law.

We do not use Contributor Content for public advertising featuring an identifiable person without any additional permission required by law.

5. How we disclose personal information

We may disclose personal information to:

  • Service providers and processors that provide hosting, storage, content delivery, analytics, communications, identity verification, payments, rewards, customer support, security, data labeling, reconstruction, model training, and device operations. They may process information only for contracted purposes.
  • Customers and research partners, such as AI and robotics companies, simulation providers, research institutions, and enterprise customers, when we license qualifying contributed data, datasets, simulation environments, model services, or evaluation tools. Depending on the product, this may include raw or processed captures and associated metadata. We use contractual, access, security, and use restrictions appropriate to the data and seek to remove or reduce identifiable information where reasonably possible.
  • Campaign and ecosystem partners that sponsor tasks, validate contributions, fulfill rewards, distribute devices, or operate interoperable services, as described when you participate.
  • Other users or the public when you choose a public profile, leaderboard, public rights record, or public sharing feature. Wallet activity recorded on a public blockchain may be visible permanently.
  • Affiliates for the purposes in this Policy, subject to appropriate safeguards.
  • Professional advisers and authorities where reasonably necessary for legal, audit, compliance, insurance, safety, fraud prevention, or protection of rights.
  • Transaction counterparties in connection with due diligence, financing, merger, acquisition, reorganization, bankruptcy, or sale of all or part of our business, subject to appropriate confidentiality protections.
  • Others at your direction or with your consent.

We do not disclose personal information to third-party customers merely because it might be useful. Customer access must be tied to a product, license, research collaboration, or service and governed by contract and access controls.

“Sale” or “sharing” under U.S. state privacy laws

Some U.S. laws define “sale” broadly to include transferring personal information for money or other valuable consideration. Licensing contributed data that remains reasonably linkable to a person may be treated as a “sale” even though it is part of the contributor program. If such laws apply, you may opt out as described in Section 11, and we will provide any required “Do Not Sell or Share My Personal Information” mechanism. We do not knowingly sell or share the personal information of people under 16.

We may use analytics or advertising technologies that constitute “sharing” for cross-context behavioral advertising under some laws only after providing required notice and choice. We honor Global Privacy Control signals where legally required.

6. Legal bases for processing in the EEA, UK, and similar jurisdictions

Where applicable, we rely on one or more of these legal bases:

  • Contract: to create and administer your account, provide requested Services, process submissions, and issue earned rewards.
  • Legitimate interests: to secure and improve the Services, assess data quality, prevent fraud, conduct proportionate research and product development, manage business operations, and protect legal rights, where those interests are not overridden by your rights.
  • Consent: for optional precise location, certain device permissions, non-essential cookies, marketing, publicity, and sensitive or biometric processing where consent is required. You may withdraw consent at any time, without affecting prior lawful processing.
  • Legal obligation: to meet tax, accounting, sanctions, safety, law-enforcement, and regulatory duties.
  • Legal claims or vital interests: where necessary to establish or defend claims or protect someone’s life or safety.

Where we seek to use personal information for a materially different purpose, we will provide additional notice and obtain consent where required.

7. Data retention

We retain personal information only as long as reasonably necessary for the purposes described in this Policy, including to provide the Services, administer rewards, comply with law, resolve disputes, enforce agreements, and maintain security and audit records. Retention depends on the nature of the data, sensitivity, legal obligations, risk, customer commitments, and technical context.

Typical criteria include:

  • account and transaction records are retained while the account is active and for the applicable legal, tax, audit, and dispute period afterward;
  • security logs and device telemetry are retained for a limited period appropriate to security and diagnostics;
  • rejected or incomplete uploads are deleted or de-identified after a limited review and fraud-prevention period, unless needed for a dispute or legal obligation;
  • accepted Contributor Content may be retained for the life of the applicable dataset, customer license, research project, or model-development cycle; and
  • public blockchain records may be effectively permanent and cannot be deleted by 4Dlabs.

If you request deletion, we will delete or de-identify covered personal information unless retention is legally permitted or required. Information already licensed to a customer may remain with that customer under its existing license and legal obligations. Data incorporated into a trained model, aggregated dataset, statistical measure, or derived output may not be technically separable; we will not use this exception to keep an identifiable source copy when deletion is otherwise required. Backup copies are isolated and deleted on their normal cycle unless restoration is required for security or disaster recovery.

Before launch, 4Dlabs will publish a retention schedule with defined periods for major data categories or make those periods available on request at support@4dlabs.space.

8. Security

We use administrative, technical, and physical measures designed to protect personal information, which may include access controls, encryption in transit and at rest where appropriate, logging, environment separation, rights review, vendor diligence, and incident response. No system is completely secure. You are responsible for protecting your credentials, devices, wallets, and capture files before upload.

If a breach affects your personal information, we will investigate and provide legally required notices.

9. Cookies, analytics, and device permissions

We may use:

  • strictly necessary cookies or storage for authentication, security, load balancing, and preferences;
  • analytics tools to understand use and performance; and
  • marketing technologies only with any notice and consent required in your location.

Where required, a consent tool will let you accept, reject, or change non-essential cookie choices. You can also use browser controls, but disabling necessary storage may prevent features from working.

Mobile and capture features may request camera, microphone, photo library, Bluetooth, local network, motion, nearby-device, or location permission. The app will request permission through your operating system. You can change permissions in device settings, although a capture feature may then stop working. Precise location collection should be off by default unless needed for a disclosed task or feature.

10. International data transfers

4Dlabs, its providers, customers, and research partners may operate in countries other than yours. Those countries may have different data-protection laws. Where required, we use recognized transfer safeguards, such as adequacy decisions, standard contractual clauses, the UK International Data Transfer Addendum or Agreement, contractual protections, and supplementary security measures. You may request information about applicable safeguards at support@4dlabs.space.

11. Your choices and privacy rights

Depending on your location, you may have the right to:

  • know or access personal information and receive information about its sources, purposes, and recipients;
  • correct inaccurate information;
  • delete personal information;
  • obtain a portable copy;
  • object to or restrict certain processing;
  • withdraw consent;
  • opt out of sale, sharing, targeted advertising, or certain profiling;
  • limit certain uses of sensitive personal information;
  • appeal our decision on a request; and
  • complain to your local data-protection authority.

Submit requests by email to support@4dlabs.space. Describe your request and the account, capture, device, wallet, or submission involved. We may verify your identity and authority, but we will request only information reasonably necessary to do so. An authorized agent may submit a request where permitted by law. You will not be discriminated against for exercising privacy rights.

To opt out of a legally defined sale or sharing, email support@4dlabs.space with the subject line “Do Not Sell or Share My Personal Information.” Where required, we also treat a recognized Global Privacy Control signal as an opt-out for the browser or device sending it. Because contributed data may already have been licensed or incorporated into derived outputs, an opt-out generally applies prospectively and does not invalidate completed transactions where the law allows them to continue.

If we deny a request, we will explain why and describe any appeal method. You may appeal by emailing support@4dlabs.space with the subject line “Privacy Appeal.”

Where applicable, you may contact 4Dlabs regarding EEA or UK data-protection matters at support@4dlabs.space. If applicable law requires 4Dlabs to appoint a local representative or Data Protection Officer, the relevant contact details will be published here before the affected Services are offered.

12. California notice at collection

This section supplements the Policy for California residents. In the preceding 12 months, we may have collected the following statutory categories: identifiers; customer records; commercial information; internet or electronic network activity; geolocation; audio, electronic, visual, thermal, olfactory, or similar information; professional or employment information; inferences; and sensitive personal information such as precise geolocation, account credentials, or biometric information if a separately disclosed feature processes data for identification.

We collect these categories from the sources in Section 3 and use them for the business and commercial purposes in Section 4. We retain them using the criteria in Section 7. We may disclose each applicable category to service providers, customers and research partners, affiliates, campaign partners, professional advisers, authorities, and transaction counterparties as described in Section 5.

In the preceding 12 months, we may have “sold” identifiers, geolocation, visual or audio information, sensor or spatial data, and associated inferences when qualifying contributed data was licensed for valuable consideration and remained reasonably linkable to a person or household. We may have “shared” identifiers, network activity, and inferences with advertising or analytics partners if cross-context behavioral advertising was enabled. We do not knowingly sell or share personal information of people under 16.

California residents may exercise the rights described in Section 11. If we use or disclose sensitive personal information for purposes beyond those permitted without a limitation right, we will provide a “Limit the Use of My Sensitive Personal Information” mechanism.

We do not offer financial incentives tied to personal information unless we provide a separate Notice of Financial Incentive explaining the material terms, value calculation, and withdrawal method. Contributor points or rewards compensate task participation and licensed content under published program terms; where a program is legally considered a financial incentive, the separate notice will control.

13. Children

The Services are for adults and are not directed to anyone under 18. We do not knowingly collect personal information directly from children. Contributors must not capture or upload content depicting or relating to a child unless a specific 4Dlabs program expressly permits it and provides a verified parental-consent and safeguarding process.

If you believe we hold a child’s personal information, contact support@4dlabs.space. We will investigate and delete it where required.

14. Automated processing

We may use automated systems to score data quality, detect fraud or duplication, rank scarcity, recommend tasks, moderate uploads, calculate provisional points, and support security. These systems may affect acceptance or reward eligibility. Where legally required, you may request human review, express your view, or contest a decision by contacting support@4dlabs.space.

We do not use solely automated decision-making that produces legal or similarly significant effects unless we provide the notice, safeguards, and choices required by law.

15. Third-party services and public blockchains

Third-party websites, wallets, app stores, social platforms, and devices have their own privacy practices. Review their policies before use. Public blockchains are not controlled by 4Dlabs; wallet addresses and transactions recorded on-chain may be public, replicated globally, and effectively impossible to erase. Avoid linking a wallet to information you do not want publicly associated with it.

16. Changes to this Policy

We may update this Policy as the Services and law change. We will post the updated version and effective date. If a change materially affects how we use previously collected personal information, we will provide additional notice and obtain consent where required.
